LOCAL LAW NO. 2 OF 2021
LOCAL LAW Enacted by the Village of Farnham, Code Chapter 46 to provide for the appropriate maintenance and care of farm animals on any property within the Village of Farnham.
BE IT HEREBY ENACTED, that the Village Board of Trustees of the Village of Farnham pursuant to Municipal Home Rule Law Sec. 10, General Municipal Law Sec. 96a, and General Municipal Law Article 5-K, as follows:
Sec. 1 Title: Maintenance and Care of Farm Animals within the Village of Farnham.
Sec. 2 Purpose: Every owner of any lot, land, residence or business within the Village of Farnham that house farm animals is hereby required to maintain any and all farm animals in a confined space no closer than 100' from any adjoining dwelling.
Sec. 3 Farm Animals Defined: Farm animals shall include, but not be limited to horses, cows, chickens, goats, sheep, and lambs.
Sec. 4 Permit: Any property owner desiring to maintain farm animals on private property situated within the Village of Farnham shall secure a permit from the Village Code enforcement Officer prior to establishing a designated space for the housing and maintenance of such farm animals; such permit shall identify the number of animals and the specific species that will be maintained on the given piece of property. Any permit shall be issued incident to an application and a payment of a permit fee in the amount of $50.00.
Sec. 5 Determination of existence of a noxious condition or nuisance: The Board of Trustees or its duly designated representative shall determine if any such maintenance of farm animals constitutes an unhealthy environment, or exudes a noxious odor creating a nuisance or health hazard to any resident or residents within the Village of Farnham.
Sec. 6 Enforcement: if it has been determined that a noxious condition or nuisance exists as a result of the improper maintenance and/or care of farm animals, the Village Clerk shall give notice to the owner of such lot, land or place upon which such condition exists, by mailing to such owner a written notice at his (her) last known address.
Sec. 7 Non-Compliance: The person upon whom notice has been served to correct or ameliorate the aforementioned conditions associated with the maintenance of farm animals and who for five (5) days after service shall neglect or fail to comply with the provisions of any such notice, shall be deemed to have violated this chapter.
